General Terms and Conditions of Use for edu.geniuskey.it
Welcome to Genius Key Energy (the Site), the document and content sharing platform that allows you to share your files and notes, download documents of interest, download paid digital files uploaded by other Users, and access additional services provided by Genius Key Energy S.r.l.s., located in Montegranaro (FM), VAT 17616621004 (hereinafter, Genius Key Energy).
These General Terms govern the access, navigation, and use of the Site and apply to all visitors and/or users (Users). By navigating the Site and using its content, the User acknowledges having read, understood, and accepted these General Terms. For assistance: edu@geniuskey.it.
1.1 To fully use the Site's features, the User must register. Failure to provide requested data results in the inability to access Services. For personal data processing, please refer to the Privacy Policy.
1.2 Registration is unique for all web services offered by Genius Key Energy.
1.3 Registration is permitted to persons of legal age or minors at least 14 years old with parental consent. The User guarantees the accuracy and truthfulness of the data provided.
1.4 Genius Key Energy may suspend the account if the information provided proves to be false or incomplete. The User agrees to keep their data updated.
1.5 Credentials (username/email and password) are strictly personal. The User is responsible for their secrecy and for any activity carried out through their account, indemnifying Genius Key Energy from any third-party claims.
1.6 The use of a nickname to conceal identity from other Users is permitted, but the true identity may be used by Genius Key Energy for legal or security purposes.
1.7 The User must immediately report any unauthorized use of their account.
2.1 To use content, it is necessary to subscribe to a Plan and use Points available in the Genius Key Energy Virtual Wallet.
2.2 Plans: There are Free Plans (activated upon registration) and Premium Plans (paid, with specific duration).
2.3 Points: "Base Points" (blue) are obtained for free through site activity and are used for shared documents. "Premium Points" (yellow) are included in paid plans or purchasable via "Power Ups" and are used for specific content.
2.4 Virtual Wallet: This is the account area where the User manages their points. It is not a bank payment account.
2.5 Nature of Points: Points are NOT legal tender, are non-refundable in cash, and cannot be exchanged or sold outside the platform. Violation results in account closure.
2.6 Points Expiration: Premium Points expire at the end of the Premium Plan unless renewed. Points purchased with Power Ups are valid for 12 months.
2.7 Base Services: Free, allow upload, download via Base Points, and community interaction.
2.8 Premium Services: Paid, allow downloading Store content, no ads, and advanced features. Renewal is automatic unless cancelled.
2.9 Marketplace (Store): Users can sell documents ("Store Documents") in exchange for Premium Points. Sellers receive compensation in Euros from Genius Key Energy, withdrawable to PayPal upon reaching €10. Genius Key Energy retains a commission and acts solely as a technological intermediary.
3.1 By uploading content, the User authorizes Genius Key Energy to host and publish it free of charge.
3.2 The User authorizes other Users to view and download the content according to Site rules.
3.3 The User grants Genius Key Energy a non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, adapt, publish, and commercially exploit the uploaded content worldwide and on any medium.
3.4 Genius Key Energy may apply logos or watermarks to documents to promote the service.
3.5 Content management is the responsibility of Genius Key Energy.
3.6 The email of the downloading User may appear on downloaded documents for security and traceability reasons.
3.7 The User accepts the risks associated with online sharing and releases Genius Key Energy from liability for illicit use by third parties.
3.8 Genius Key Energy may remove content at any time without notice.
3.9 Documents created via AI on the site are for personal use only. Sale or external distribution is prohibited.
4.1 The User is solely responsible for uploaded materials.
4.2 The User guarantees to be the author or hold rights to the content, and that it does not infringe copyright, is not managed by copyright collecting societies (e.g., SIAE), and is not illegal, offensive, or defamatory.
4.3 Content must not have DRM blocks or contain viruses/malware.
4.4 The User indemnifies Genius Key Energy against any claim for damages by third parties for copyright infringement or other illicit acts related to uploaded content.
5.1 The User agrees: not to use the site for unauthorized commercial purposes or spam; not to violate laws or copyright; not to spread malware; not to attempt to bypass Site security; not to engage in data scraping; not to harass other users.
6.1 Genius Key Energy may remove, at its discretion and without notice, content that violates rules, third-party rights, or is deemed inappropriate.
6.2 The User may request removal of their files by contacting support, but files already shared may remain in the system under the granted license.
7.1 The User may withdraw at any time by requesting account closure at edu@geniuskey.it. Closure will occur within 10 business days. Withdrawal does not imply refunds for services already paid.
7.2 Genius Key Energy may close the account immediately in case of violation of General Terms, illegal use, or false data.
8.1 The interface, graphics, code, software, and Genius Key Energy brand are the exclusive property of Genius Key Energy S.r.l.s. and are protected by copyright.
9.1 The Site may contain links to third-party sites. Genius Key Energy does not control such sites and is not responsible for their content or any damage resulting from their use.
10.1 Genius Key Energy provides only the technological platform. It is not responsible for interactions between Users or the quality of exchanged content.
10.2 Genius Key Energy has no obligation of preventive monitoring of uploaded content and is not liable for copyright infringements committed by Users.
10.3 The Site is provided "as is". No guarantee is made regarding the absence of errors, interruptions, or viruses.
10.4 Genius Key Energy is not liable for direct or indirect damages resulting from Site use, file downloads, or data loss.
10.5 The User indemnifies Genius Key Energy from any legal liability arising from their use of the platform.
11.1 Genius Key Energy reserves the right to modify these terms at any time by publishing the new version on the Site. Continued use of the Site implies acceptance of the changes.
12.1 Personal data is processed in compliance with GDPR and Italian law. For details, consult the Site's Privacy Policy.
13.1 These Terms are governed by Italian law.
13.2 Any dispute shall be exclusively settled by the Court of Fermo (FM), except for the consumer forum where provided by law for consumer users.
